Delivery Gadgets for Jira Cloud is provided under the Bonterms Standard End User Agreement (Version 1.0), which Atlassian offers for Marketplace apps, together with the Provider-Specific Terms below. Where the two differ, the Provider-Specific Terms take precedence (section 1.4 of the Standard Agreement). The Provider-Specific Terms that apply to a subscription are those entered for the app version in the Atlassian Marketplace; this page reproduces them.
Provider-Specific Terms
Provider: Marco Spörl, Germany (Marketplace vendor name: Marco Spoerl).
- Product. The Product is Provider Software. Provider does not operate a Cloud Service. The Product runs on Atlassian's Forge platform in the User's browser and transmits no Customer Data to Provider; Provider neither receives nor stores Customer Data. Accordingly, no Data Protection Addendum is identified under section 3.3 and no Security Measures are identified under section 3.2. How the Product handles data is described in the App Privacy Policy at https://deliverygadgets.com/app-privacy-policy.
- Free subscriptions. Subscriptions provided free of charge for sites within the free-tier limit stated in the Listing are Subscriptions for productive use, not Trials and Betas within the meaning of section 18. Section 18 applies only to time-limited trials offered through the Marketplace.
- Business customers. The Product is offered exclusively to businesses (Unternehmer within the meaning of section 14 of the German Civil Code, BGB), not to consumers.
- Limitation of liability.
- For the General Cap, amounts paid or payable for the Product through the Marketplace, including to Atlassian or another reseller, count as amounts paid or payable to Provider.
- The General Cap is at least US$1,000.
- Provider's obligations under section 15.1 are Enhanced Claims, not Uncapped Claims, and are subject to the Enhanced Cap.
- Nothing in the Agreement limits or excludes Provider's liability for intent or gross negligence, for injury to life, body or health, or under the German Product Liability Act (Produkthaftungsgesetz).
- Governing Law and Courts. The Governing Law is the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The Courts are the courts of Munich, Germany, to the extent permitted by law.
- Notices. Provider's notice address is hello@deliverygadgets.com for email; its postal address is stated in the site notice at https://deliverygadgets.com/site-notice.
